Recommended Amendments to ORS 420A.203

(Eligibility for Second Look)

 Create opportunity for earned review, or second looks, for all persons who were under 18 years of age at the time of the commission of the offense for which the persons were sentenced to a term of imprisonment after serving 26 years of a sentence.
Provide persons denied parole after initial earned review eligibility for reviews every two years.

Youth are different than adults biologically and psychologically.
Youth are more susceptible to peer pressure, more impulsive, and more likely to take risks than adults.
Adolescent brains are still developing, which means youth are more capable of change than adults.
HOW
Protect youth from cruel and unusual punishment by providing a meaningful opportunity for release.
WHAT
Provide second looks to all youth after 26 years of incarceration, and eligibility for reviews every two years thereafter.
